Terms of use

This terms of use agreement governs your access to, and use of, the CurrencyConverterPro application and related services developed by Cara Gilbert.

These Terms of Use ("Terms", "Terms of Use") govern the relationship between you and Cara Gilbert ("Cara Gilbert", "us", "we", or "our") in relation to the use of the Currency Converter Pro mobile/web application (the "App" or "Service").

These Terms of Use apply to all visitors, users, and others who access or use the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

  1. Eligibility In order to use the Service, you must:
  • be at least eighteen (18) years old and legally capable of entering into contractual obligations;
  • agree to these Terms;
  • provide true, complete, and up-to-date information; and
  • not be subject to EU, US, or UN sanctions, embargoes, or bans that prohibit the use of this Service.

By using the Service, you represent and warrant that you meet all the above requirements and that you will not use the Service in violation of any applicable laws or regulations.

Cara Gilbert reserves the right to refuse service, close accounts, or change eligibility requirements at any time.

  1. Subscriptions Some features of the Service are available on a subscription basis ("Plan(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing Cycles are typically set on a monthly basis, depending on the subscription plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it. You may cancel your Subscription renewal through your account settings or by contacting Cara Gilbert's customer support, subject to a notice period of at least 30 days.

  1. Free Plan Cara Gilbert may, at its sole discretion, offer a free version of the Service ("Free Plan"). You will not be charged for using the Free Plan.

Cara Gilbert reserves the right to modify the terms of the Free Plan or cancel the Free Plan offer at any time without notice.

  1. Fee Changes Cara Gilbert may, in its sole discretion and at any time, modify the Subscription fees. Any fee change will become effective at the end of the then-current Billing Cycle.

We will provide you with reasonable prior notice of any fee change to allow you the opportunity to cancel your Subscription before the change takes effect.

Your continued use of the Service after the fee change becomes effective constitutes your agreement to pay the modified fees.

  1. Authorized Use of the Service You may only use the Service for lawful purposes and in a manner consistent with its intended functionality as a currency conversion application.

You agree not to use the Service for any unlawful, fraudulent, or unauthorized purposes.

  1. Accounts When you create an account, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms and may result in termination of your account.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree not to disclose your password to any third party and must notify us immediately of any unauthorized access or breach of security.

  1. Intellectual Property The Service, including the CurrencyConverterPro App and its original content, features, and functionality, are and shall remain the exclusive property of Cara Gilbert and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You may not use our trademarks, logos, or trade dress without prior written consent.

  1. Links to Third-Party Services The Service may contain links to third-party websites or services that are not owned or controlled by Cara Gilbert.

Cara Gilbert has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Cara Gilbert shall not be responsible or liable for any damage or loss caused by or in connection with the use of or reliance on any such third-party content or services.

  1. Data Protection Any personal information you provide will be collected, processed, and used in accordance with our Privacy Policy.
  2. Termination We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately.

  1. Limitation of Liability In no event shall Cara Gilbert, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, or goodwill, resulting from (i) your use of or inability to use the Service; (ii) any conduct or content of any third party; or (iii) any other matter relating to the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.
  2. Disclaimer Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

Cara Gilbert does not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses, nor that it will meet your specific requirements.

  1. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of California and the applicable federal laws of the United States of America, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction and venue of such courts.

  1. Changes to These Terms We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide notice prior to the changes taking effect.

By continuing to access or use the Service after the revised Terms become effective, you agree to be bound by the new terms. If you do not agree to the new terms, please stop using the Service.
